OFFICIAL CONTEST RULES
1. Eligibility.
No purchase necessary. The contest is open to residents of any country, unless prohibited by law. Contestants may be less than the age of majority in the country in which they reside, however approval must be received from a parent or guardian should the contestant win the contest. Employees of theWebisFree.com, Simon's Smokehouse Inc., Newcon Optik Inc., Excite.com (collectively the "Contest Sponsors") and their respective affiliated companies, advertising and promotional agencies and the immediate families (spouse, children, parents and siblings) and persons living in the same household of such employees are not eligible to participate. In order to win, the eligible winner must correctly answer a mathematical skill-testing question.
2. How to Enter.
The contest opens on September 29, 2000 and closes on the receipt of 2,500 eligible entries (the "Contest Period").
To submit an eligible entry, follow these steps:
You may enter as many eligible entries as you wish. Only one eligible entry per unique username. A maximum of 2,500 eligible entries will be accepted.
Contest Sponsors shall not be responsible for any lost, delayed, stolen, damaged, misdirected, late entries or for entries not received due to computer or technological error or failure or other such reasons. Without limiting the generality of the foregoing, Contest Sponsors shall not be liable or responsible for any failure of the web site during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received by the Contest Sponsors on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion.
3. Prize.
One (1) Grand Prize of a Newcon Optik MB-3 All-Weather Night Vision Scope. Any additional accessories are not included. The Grand Prize must be accepted as awarded. The winner will be able to take delivery of the Grand Prize within 10 weeks after being declared the official winner. Approximate retail value of the Grand Prize is $630 CDN including delivery. All applicable taxes, duties and import charges are the responsibility of winning contestant.
4. Selection process.
A random draw for the Grand Prize will take place from all eligible entries received at the offices of theWebisFree.com when 2,500 eligible entries have been received. Odds of winning are 1 in 2,500. The eligible winner will be notified within 5 business days of the draw by Email. If an eligible winner cannot be contacted after reasonable attempts to contact him/her, the prize will be forfeited and an alternate eligible winner will be chosen by random draw and according to these rules. In order to be declared a winner, each entrant whose entry is drawn will be required to correctly answer, unaided, a mathematical skill testing question. In addition, the eligible Grand Prize winner will be required to sign an Affidavit of Eligibility (which includes the skill testing question that must be answered correctly) and a Liability Release and Publicity Release and return it within ten (10) business days of receipt.
5. Additional Terms.
By entering, participants agree to release, discharge and hold harmless, the Contest Sponsors, their respective affiliates, employees, contractors, advertising and promotion agencies and prize suppliers from any losses, damage, claims or liability whatsoever arising out of the acceptance, use, misuse or possession of any prize received in this contest.
No substitutions or cash equivalents permitted. With respect to the Grand Prize, no cash trade-in in lieu of the vehicle will be permitted. Contest Sponsors reserve the right to modify the prizes or substitute a prize of equal value.
This contest is subject to all applicable Federal, State, Provincial, Municipal and local laws and regulations. Entrants attorn to the jurisdiction of the courts of Ontario in respect to any claim whatsoever in relation to this contest. Sponsors reserve the right to terminate or to amend this contest at any time and in any way without prior notice if any factor interferes with its proper conduct as contemplated by these rules. Without limiting the generality of the foregoing, the Contest Sponsors reserve the right in their sole discretion to cancel or suspend the e-mail portion of this contest should a virus, bug or other cause beyond the reasonable control of the Contest Sponsors corrupt the security or proper administration of the contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, the Contest Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way. By entering this contest, all entrants acknowledge having read and accepted these rules. All decisions on all matters of fact, interpretation, eligibility, procedure, judging, and fulfillment made by the Contest Sponsors with respect to any matter arising from the conduct of this contest and/or the awarding of any prize shall be final and binding on all entrants.
All entries become the property of the Contest Sponsors and will not be returned. By entering, all entrants consent to the use by the Contest Sponsors of their name, photograph or likeness and their contest entry without compensation.
